When purchasing tickets for the Concordia Ball both via the Web Shop and via the Ball Office in the Concordia Press Club, Bankgasse 8, 1010 Vienna and at the box office, the following General Terms and Conditions apply:
1. Scope of Application For the business relationship between the Concordia Press Club as organiser and the purchasers of ball tickets, the following General Terms and Conditions apply exclusively in the version valid at the time of the order. We only accept deviating terms and conditions if we ourselves have expressly agreed to them in writing. 2. Conclusion of Contract 2.1 Your order is an offer to us to conclude a sales contract to which you are bound by the transmission of the order. Ball tickets can only be ordered online (in special exceptional cases by e-mail or telephone). However, the contract is not concluded until you receive confirmation of your order from the ball office. 2.2 We are entitled to accept orders only in part. 2.3 Online orders of ball tickets are only possible if all mandatory fields are filled out correctly. Before sending the order, the customer receives a compilation of his order. 2.4 Concordia Press Club reserves the right to cancel orders and contracts at any time (unilateral right of withdrawal) if the customer violates or attempts to circumvent specific conditions of the Concordia Press Club or the venue relating to the event which were explicitly referred to in the context of the advance sale. This may be the case, for example, if ticket limitations are violated. 2.5 By purchasing the ticket, the customer accepts the house rules applicable at the venue (Vienna City Hall). Persons who are not dressed according to the dress code of the venue or the Concordia Press Club may be denied entry to the event without compensation. 2.6 Tickets are sold online via the web shop. Admission tickets will be issued exclusively as Print@Home tickets and sent to the customer in PDF format by e-mail or handed over at the advance booking office. 3. Placement Requests You can select your seats in the online shop. If you have special placement requests, please let us know directly. The Ball Office will make every effort – depending on availability – to take this into account. Tables for 4 and 8 persons are available in the gallery and in the adjoining rooms; tables for 10 persons in the Festival Hall and tables for 8 persons in the loge boxes. Without exception, only two seats will be sold together. 4. Prices/Payment 4.1 All prices quoted are inclusive of all taxes. Delivery costs will be charged separately according to the information provided. 4.2 The purchase price can be paid by credit card (VISA, MasterCard, JCB) or immediate bank transfer for bookings on the Internet and exclusively in cash for purchases in the ball office. 4.3 The purchased tickets will only be issued or dispatched after receipt of the paid amount. 4.4 Concordia Press Club accepts no liability for any damage caused by the fact that the payment transaction was not carried out by the bank commissioned and/or for any documents lost by post. In particular, the Press Club assumes no liability for delivery by third parties. 5. Delivery and use of tickets 5.1 Admission tickets shall be created as Print@Home tickets and sent to the customer in PDF format by e-mail or as a printout at the ball office or, if requested, as a printout by post (shipping charges apply). Österreichische Post AG will ship the goods at the customer's risk and expense to the delivery address specified by the customer. The indication of delivery dates is not binding. The Concordia Press Club reserves the right to terminate the postal dispatch of ball tickets four weeks before the day of the event. 5.2 The Print@Home ticket is deemed to be an admission ticket, which must be presented as a printout or as an electronic ticket at the entrance to the event location. 5.3 The customer is obliged to check the tickets for correctness and completeness (in particular the event title, date and time, ticket price and number) immediately upon receipt and to notify the Concordia Press Club in writing by e-mail to [email protected] of any complaints immediately, but no later than five working days after purchase. In the event of subsequent complaints, faulty deliveries may not be corrected in good time before the start of the event so that attendance at the event is no longer possible. The Concordia Press Club does not accept any liability for properly transmitted postal and electronic mail. Claims for damages resulting from the non-delivery of Print@Home tickets cannot therefore be accepted. If a Print@Home ticket is lost, no compensation can be paid. The Print@Home tickets may not be misused, copied or passed on. The principle of first access applies to access (= the Print@Home ticket which, with its unique identification, is accepted first as the valid one). Subsequent tickets with identical access authorization – e.g. copied tickets - are automatically cancelled by the access of the first ticket. The one-time ticket code on the Print@Home tickets is validated at the venue by means of a code scanner. Tickets with a validated code do not entitle the holder to enter the event. 6. Delivery/Delivery Time Non-compliance with the delivery dates shall entitle the customer in any case only to assert his right of withdrawal if we do not carry out the delivery despite a written request and the setting of a two-week grace period. 7. Right of Rescission In accordance with §5 Consumer Protection Act, there is no right of withdrawal for contracts for services in the field of leisure activities. Thus, there is no right of withdrawal when purchasing ball tickets or services connected with the visit to the ball, such as table and box reservations. 8. Cancellation of the Event Minimum postponements and other changes to the content of the event do not entitle the holder to return a ticket if they are minor, reasonable and objectively justified. The tickets remain valid in any case. On the other hand, a cancellation of the event entitles the customer to a refund of the purchase price vis-à-vis the organiser if the fault lies with the Concordia Press Club. In this case, the customer has the possibility to return the tickets within a period of 7 calendar days in order to receive a full refund of the purchase price. If the customer does not request the return of the tickets within the specified period of time, the customer's claims for the return of the tickets shall lapse definitively. However, the right of rescission does not exist vis-à-vis the Concordia Press Club if the venue becomes unusable for whatever reason. The latter shall apply in particular if the execution of the event has to be cancelled or restricted in whole or in part by official measures. 8.1 Cancellation due to COVID-19 regulations The Concordia Ball will only take place if the legal requirements of the Austrian Federal Government due to COVID-19 allows the ball to be held properly. If the ball cannot take place on the scheduled date due to the applicable regulations, entrance and table seat tickets remain valid for the alternative date. At customer's request, vouchers can be issued or the ticket price refunded. 9. General Terms and Conditions According to the festive setting the following dress code applies: Floor-length evening dresses, tuxedos, dinner jackets and gala uniforms with bow tie. We reserve the right to refuse entry to guests in short or half-length dresses, in trousers or trouser suits or in day suits. In the event of loss of an access authorisation, no replacement can be made. By purchasing this ticket, the visitor submits to the house rules of the venue and accepts the general terms and conditions of the organiser. When leaving the venue, the tickets lose their validity. 10. Data Protection The customer agrees that the data provided in the context of the order may be collected, processed, stored and used for accounting purposes and for internal marketing purposes. The data will be used by us to comply with statutory regulations, to process payment transactions and for advertising purposes. They will not be passed on to third parties. Please refer to our data protection declaration for details. By visiting the Concordia Ball, you expressly consent to the publication of photographs and film footage taken during the Concordia Ball. 11. Applicable Law/Jurisdiction 11.1 The legal relationship with the customer shall be governed exclusively by Austrian substantive law. 11.2 The place of payment and performance for all obligations arising from this contract shall be Vienna. 11.3 The place of jurisdiction for all disputes arising from the contract shall be the court having local and factual jurisdiction for 1010 Vienna. We process your data on the basis of the legal regulations. In this data protection information, we inform you about the most important aspects of our data processing. If personal data (e.g. name, address or e-mail address) is collected on our pages in the shop, this is always done on a voluntary basis. Data Processing for the Purchase of Ball Tickets, Table and Box Seats The following data will be stored by us for the purpose of processing the contract: Name, address, company, e-mail address and telephone number. The data provided by you is necessary for the fulfilment of the contract or for the implementation of pre-contractual measures. No data will be transferred to third parties, with the exception of the transfer of credit card data to the processing bank institutes / payment service providers for the purpose of debiting the booking price and to our tax consultant for the fulfilment of our tax obligations. If the booking is cancelled, the data stored by us will be deleted. If a contract is concluded, all data from the contractual relationship will be stored until the end of the tax retention period (7 years). The data processing is based on the legal provisions of § 96 Abs 3 TKG as well as Art 6 Abs 1 lit b of the DSGVO. A recognized and proven technology is used for payment processing by credit card. Payment information is transmitted via an SSL connection with the highest possible encryption to our payment service provider mPAY24. Confirmation of payment is only permitted from mPAY24 IP addresses. |
